AGE DISCRIMINATION

Age discrimination occurs when an employer treats a job applicant or an employee less favorably because of his or her age. Age discrimination in the workplace is  is prohibited by both federal and Michigan state law. Discharging or otherwise discriminating against workers over 40 years of age violates the Federal Age Discrimination in Employment Act, known as the ADEA. Cases can involve the failure to hire, promotions, pay, job assignments, layoffs, training, and fringe benefits. Not all employers are covered by the ADEA. In some instances, age discrimination cases are brought in federal court, state court, the U.S. Equal Employment Opportunity Commission, or the Michigan Department of Civil Rights. The best venue for an age discrimination claim is one that should be discussed with an attorney experienced in employment discrimination.
